TERMS AND CONDITIONS
From this point forward Rummans Firearms, LLC and DBA Rummans Coating Specialists will be referred to as “Rummans Firearms & Coating Specialists.
From this point forward “Client” or “Customer” will refer to the individual who signed a Work Order, Transfered items or conducted business with Rummans Firearms & Coating Specialists.
Work Order
Rummans Firearms & Coating Specialists work orders are considered an estimate for services and may not represent your final invoice.
By agreeing to the work order the customER understands and agrees that any parts or materials needed to complete said work order that are considered immaterial (Under $50) will be ordered and used at the discretion of Rummans Firearms & Coating Specialists. Furthermore any parts or materials needed to complete said work order that are considered material (Over $50) will require the approval from the client before work will proceed.
By agreeing to the work order the customer understands that the labor charges are an estimate of the hours required to finish said work order. The client agrees to pay an increase of up to 25% of the original labor estimate without contact. If the labor hours are to exceed 25% of the original estimated labor, Rummans Firearms & Coating Specialists will stop work and contact customer to discuss how to proceed with the work order.
Work Orders are individual per firearm or item and will not be grouped or bundled. If you have multiple Work Orders with Rummans Firearms & Coating Specialists the customer understands that the Terms and Conditions and Limits of Liability apply to each individual Work Order.
All Work Orders dropped off in person will be returned to the client listed on the Work Order or returned to the FFL of origin. No exceptions.
All Work Orders Shipped in will be returned to the originating location. No Exceptions. See Shipping Terms for further details.
Turn Around
4-12 Weeks is the standard turnaround time for all work performed by Rummans Firearms & Coating Specialists.
This estimated time to completion is non-binding and may change at any time due to extenuating factors without any notification to the customer. Rummans Firearems & Coating Specialists, reserves the right to process and complete work orders in whatever order it sees fit solely based on its own discretion.
Rummans Firearms & Coating Specialists, reserves the right to accept or reject any work order.
Rummans Firearms & Coating Specialists will provide periodic updates on your project upon request. The customer may at anytime request the work order be returned prior to completion. Rummans Firearms & Coating Specialists, will assess the fee for the work already performed based on Rummans Firearms & Coating Specialists, discretion and the rates and terms agreed upon previously by Rummans Firearms & Coating Specialists, and the customer. Rummans Firearms & Coating Specialists, reserves the right to retain possession of the work order until it has been fully compensated for the work, services and parts it has provided for said work order.
Parts
All parts needed for work must be supplied by customer or discussed and noted on work order being performed. No exceptions. Completed work orders will not be returned until all costs are paid for. Rummans Firearms & Coating Specialists will provide an assessment of all parts that are required for the work order to be completed; however, this is subject to change at any time. If Rummans Firearms & Coating Specialists determines the change in the parts required for completion to be material, then Rummans Firearms & Coating Specialists will notify the customer prior to purchasing the parts. If Rummans Firearms & Coating Specialists determines the change in the parts required for completion to be immaterial (Under $50), then Rummans Firearms & Coating Specialists will purchase the parts without customer approval and add them on to the cost of the work order. Labor prices may be quoted as a total or at an hourly rate as agreed upon by Rummans Firearms & Coating Specialists and customer. All returns are at the discretion of Rummans Firearms & Coating Specialists. See Return Policy below for more information.
Fee Schedule
Rummans Firearms & Coating Specialists reserves the right to change or modify their fee schedule at anytime without notice to the client or further parties.
Handling/Administrative Fee is used to cover the time it takes to adhere to federal documentation requirements when checking firearms in and out of Rummans Firearms & Coating Specialists ATF required records. The fee of $25 is non-refundable and is applied to any firearm that has to be checked in for service. This fee is not applicable to same day services.
Shop Minimum - $50 for any services rendered By Rummans Firearms & Coating Specialists.
Range Fee - $25 per hour will be assessed to any firearm requiring test firing, any ammo used during test firing will be added at market price per round to your final bill.
Test Ammo – market price per round will be added to final bill. Market Price is average price of the ammo used at time of test fire. Rummans Firearms & Coating Specialist reserves the right to assess market price at anytime and from any sources they deem fit. The customer also has the ability to supply ammo for test firing to avoid this fee. (Example of market price calculation 9mm at time of test fire is $0.36 per round and 25 rounds were used during test firing, $0.36x25rounds=$9. In this instance you would see a $9 Test Ammo Fee on your final bill)
Diagnostic/Research Fee - $100 accessed on any gunsmith or custom work being performed by Rummans Firearms & Coating Specialists. This fee covers any labor or time involved in researching or diagnostic of a firearm in the event the client decides not to complete gunsmithing or custom work requested. This fee is waived if the client proceeds with the gunsmithing or custom work as requested on their work order.
Storage Fee - $5.00 per day will be added to your bill in accordance with our Abandonment terms. Fee is non-negotiable and non-refundable. Rummans Firearms & Coating Specialists reserves the right to assess this fee as it sees fit. All Storage Fees must be paid in full at time of pickup or the Work Order will not be released and Storage fees will continue being assessed.
Rummans Firearms & Coating Specialists has a Labor rate of $100 per hour. This fee is assessed per hour for work being performed that does not require any special machinery or equipment.
Rummans Firearms & Coating Specialists has Machine rate of $125 per hour. This fee is assessed per hour for work being performed that requires any special machinery or equipment.
Completion
Once your work order is completed Rummans Firearms & Coating Specialists will contact you at the phone number provided on the work order. First phone call will be notated and call logs will be kept as proof of contact. The first phone call will start the clock for our Abandonment clause. At the 30 days point Rummans Firearms & Coating Specialists will contact the client a second time to notify them of completion and make them aware of storage fees that will be accessed. After 30 days Rummans Firearms & Coating Specialists have the right to access Storage Fees for the work order until the Abandonment clause kicks in, as further defined herein. Rummans Firearms & Coating Specialists will contact the client at the 60 days and 90 days point after completion. After 90 day, Rummans Firearms & Coating Specialists Abandonment Term will kick in and no further contact with the client will be made.
Completion Timeline
First Contact – By Phone – 90 days time line starts
30 days Second Contact – By Phone – Storage Fees start being accessed
60 days Third Contact – By Phone – Storage Fees Continue
90 day Last Contact – By Phone – Storage Fees Continue and Abandonment Terms Start
Any partial payments made towards Work Order do not stop or restart the Completion Timeline. Completion Timeline will only terminate once the Work Order including all fees are paid in full and the Work Order is picked up.
Abandonment
After 90 days from completion or work order, all items and property on work order will be considered abandoned and will be sold at the discretion of Rummans Firearms & Coating Specialists to recuperate any all expenses associated to the work order. Unless other arrangements have been made in writing and both parties have agreed to said agreement terms. Agreements must be signed and dated by both parties and attached to work order within 90days of completion to be valid.
Gunsmithing
The term “gunsmithing” entails the repair, modification or any work being performed on said firearm. Rummans Firearms & Coating Specialists will not perform any Gunsmithing actions that are prohibited by state or federal laws. Some gunsmithing may alter or modify safety features and/or other factory components. All Gunsmithing is performed at the request of the client and the client agrees and understands the risks involved.
Gunsmithing services may use factory or aftermarket components. Gunsmithing services may require modification to factory or aftermarket components.
Payment
Rummans Firearms & Coating Specialists takes Cash, Check, Debit or Credit Card. A 3% fee will be accessed to all debit or credit card transactions to cover fees associated with the transaction.
Guarantee
Rummans Firearms & Coating Specialists guarantees all Gunsmith work for 30 days from the date of completion. Said Guarantee covers the work order labor only. Since the parts may be new or used, Rummans Firearms & Coating Specialist does not guarantee any parts supplied or ordered.
Rummans Firearms & Coating Specialists has guarantee that our Cerakote coatings will never crack, peel or flake. If client finds coating to fail contact rummans firearms and coating specialists to start a claim for evaluation. Rummans firearms and Coasting Speciailists will require item to be returned for full evaluation. If the claim is deemed valid Rummans Firearms & Coating Specialists will re-coat item at no additional charge. Guarantee covers Cerakote Coatings only. Any costs incurred for disassembly/assembly, shipping or any other costs associated with the item being recoated are not covered under the guarantee or Rummans Firearms & Coating Specialists, and I billable to client.
Rummans Firearms & Coating Specialists reserves the right to deny or void any guarantee at their discretion.
Returns
All sales are final. If the incorrect part is ordered by Rummans Firearms & Coating Specialists, Rummans Firearms & Coating Specialists will exchange the original item for the proper item. The exchange is on the condition that the incorrect item is not damaged or modified in any way. The incorrect item must be returned with all original components and packaging.
Shipping
Rummans Firearms & Coating Specialists has the right to ship items using any and all companies they deem fit for transportation of Work Order. All shipments will be “Signature Required” and “Insured” for the items value. Actual shipping charges will be added to final invoice. Rummans Firearms & Coating Specialists reserves the right to charge to packaging & handling fees in addition to shipping cost.
LIMITS OF LIABILITY
I the Customer/Client, acknowledge that I have voluntarily requested Rummans Firearms & Coating Specialists perform activities which may include, but are not limited to, Gunsmithing, modifications and alterations which may affect various safety systems put in place by the manufacturer. I am aware that gunsmithing, alterations and modifications of items may be hazardous. I am voluntarily requesting that these activities take place with full knowledge of the dangers involved which may include death, dismemberment, paralysis, or other injuries. I hereby agree to accept any and all risks and verify this statement by placing my signature on this contract. I release Rummans Firearms and Coating Specialists, from any and all liability for any gunsmithing, alterations or modifications that were made at my the customer/clients request. Furthermore, I, warrant herein that I am not requesting any alterations or modifications that violate any state or federal law(s).
As consideration for the gunsmithing, modification and alterations being performed pursuant to my direction, I hereby agree that I, my assignees, heirs, distributes, guardians and legal representatives, will not make a claim against, sue, or attach the property of Rummans Firearms & Coating Specialists, or any affiliated organizations, for injuries or damages resulting from negligence or other acts of Rummans Firearms & Coating Specialists, or any employee, agent or contractor of Rummans Firearms & Coating Specialists, any of it affiliated organizations as a result from my request for modification or alteration to the item.
I hereby release Rummans Firearms & Coating Specialists, and any of its affiliated organizations from all actions, claims or demands that I, My assignees, heirs, distributes, guardians or legal representatives now have or may hereafter have for injuries or damages resulting from any work performed by Rummans Firearms & Coating Specialists.
I am informed, recognize, and understand that any alterations which I have requested to be done to my firearm, pursuant to the Work Order, may release the Manufacturer from any liability for any accident should any occur and may void any/all Manufacturer’s warranties.
I am informed, recognize, and understand by reading and signing the Work Order, that by requesting that these changes occur, I am also releasing the gunsmith; both individually and in any business form, from any liability should any accident occur because of the work performed by the gunsmith.
I am informed, recognize and understand that gunsmithing, alterations and modifications to my item may void part of or all manufactures warranties or guarantees. I am informed, recognize and understand that Rummans Firearms & Coating Specialists will not adopt, take over, extend, or supply any manufactures warranties. I am informed, recognize and understand also supplies no warranties for any items it gunsmiths, alters or modifies.
The Customer will indemnify and defend Rummans Firearms & Coating Specialists from all liability for any loss, damage or injury to persons or property arising from or related to the performance of the agreement including, without limitation, all consequential damages whether or not resulting from the negligence of the Customer or Customer's agent.
If any legal action, including a legal action in contract law, tort law or criminal law, including an action for declaratory relief is brought to enforce or interpret the provisions of this contract, or a suit of liability, then the prevailing party shall be entitled to recover reasonable attorney's fees from the other party. These fees which may be set by the court in the same action or in a separate action, brought for that purpose, are in addition to any other relief to which the prevailing party may be entitled.
This agreement supersedes any and all other agreements either oral or in writing, between the Customer and Rummans Firearms & Coating Specialists with respect to the subject of this contract. This contract contains all of the covenants and agreements between the parties with respect to the gunsmithing work pursuant to the Work Order and each party to this contract acknowledges that no representations, inducements, promises or agreements have been made by or on behalf of any party, except those covenants and agreements embodied in this contract. No Agreement, statement or promise not contained in this contract shall be binding or valid.
The validity of this agreement and any of its terms or provisions, as well as the rights and duties of the parties under this agreement, shall be construed pursuant to and in accordance with the laws of the State of Florida.
If any term of this agreement is held by a court of competent jurisdiction to be void or unenforceable, the remainder of the contract terms shall remain in full force and effect and shall not be affected.
I the Customer/Client understand Rummans Firearms & Coating Specialists, The building owner, and Property Owners provides no insurance for your item or parts due to theft, flood or other act of nature, war, or any other reason. I the customer/client understand it is my responsibility to research or to contact an insurance agent with any questions related to insuring you item while in the procession of Rummans Firearms & Coating Specialists. I the customer/client understand I am solely responsible for insuring his or her item during the time it is in the possession of Rummans Firearms & Coating Specialists.
• NO IMPLIED WARRANTY OF MERCHANTABILITY IS GIVEN AND IS EXPRESSLY DENIED.
• NO IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE IS GIVEN AND IS EXPRESSLY DENIED.
• NO IMPLIED WARRANTY OF WORKMANLIKE QUALITY IS GIVEN AND IS EXPRESSLY DENIED.
I the Customer/Client acknowledge by signing I have read this document and understand it fully. I further understand that by signing this release, I voluntarily surrender certain legal rights.
RUMMANS FIREARMS & COATING SPECIALISTS RESERVES THE RIGHT TO ADD, REMOVE, CORRECT, MODIFY OR CHANGE ANY AND ALL TERMS AND CONDITIONS STATED ON RUMMANS FIREARMS & COATING SPECIALISTS WEBSITE OR ANY PUBLISHED, PRINTED, VERBAL OR DISSEMINATED INFORMATION AT ANY TIME.
